A judge in Santa Cruz puts another brake the rate hikes as unconstitutional

Judge Ana Alvarez, deputy Rio Gallegos, declared unconstitutional the executive decree which empowers the rate increases, forced to return Camuzzi extra fees charged to users

A new brake arrived today from justice to tarifazo driven by the Executive. This time, from Rio Gallegos, the deputy federal judge Ana Cecilia Alvarez declared unconstitutional a decree that enabled the rise of prices and thus Camuzzi ordered the company not to apply these charges.

The decision of the judge orders the company that does not include the charge bound tariff to the capitalization of the Trust Fund, as well as to repay the funds already collected from users of the gas. In its ruling, Alvarez decides to "declare the 2067/08 PEN incontitucionalidad decree "and resolutions of the Ministry of Federal Planning and Enargas," as created and regulate an additional charge for the capitalization of FF, according to the above considerations and without prejudice to the period of suspension established ".

The complaint did Mr Jorge Fernando Cruz and Omar Find (both legislators UCR) in a matter of users and residential consumers who constituted timely action against the State under the National Gas Regulatory Agency (ENARGAS ) and against the company Camuzzi Gas del Sur, according to the Santa Cruz site IPO.
